1. Eligibility and Parental Consent

By using our Services, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.

 

• You are the legal parent or guardian of the child(ren) who will be participating in the courses.

 

• You consent to your child’s use of the Services and agree to be bound by these Terms on their behalf.

 

• Children under 18 are not permitted to register for accounts or make purchases directly. All accounts must be created and managed by a parent or legal guardian.

 

2. User Accounts

To access our courses, you may be required to register an account. You agree to:

• Provide accurate, current, and complete information during registration.

 

• Maintain the security of your password and accept all risks of unauthorized access to your account.

 

• Notify us immediately if you discover or suspect any security breaches related to the Site or your account.

• Account Sharing: Your login credentials are for the use of your household only. Sharing login details with other families or individuals is strictly prohibited and may result in immediate account termination without refund.

 

3. Purchases and Payments

• Pricing: Prices for courses and gift cards are listed on the Site and are subject to change without notice.

 

• Currency: All transactions are processed in United States Dollar (USD).

 

• Gift Cards: Gift cards are valid for 12 months from the date of purchase. They are non-refundable and cannot be exchanged for cash, except where required by law.

 

• Taxes: You are responsible for any applicable sales tax or VAT associated with your purchase.

 

4. Refund and Cancellation Policy

• Course Refunds: If you are not satisfied with a course, you may request a partial refund of $80 prior the start of the second session. If request is sent after the second session then the tuition becomes non-refundable.

 

• Live Class Cancellations: Missed sessions with or without notice are non-refundable.

 

• Cancellations by Us: In the event that BIG Kids Academy must cancel a course or live session due to instructor illness or technical issues, we will offer a full refund for that session or a reschedule option.

5. Student Conduct and Safety
To ensure a safe and positive learning environment for all children, we enforce a strict Code of Conduct.

 

• Behavior: Bullying, harassment, hate speech, or inappropriate language by students (or parents in the background) will not be tolerated.

 

• Dress Code: Students must be fully and appropriately clothed during live video sessions.

 

• Environment: Please ensure your child joins from a quiet, public area of the home (not a bedroom or bathroom) whenever possible.

 

• Recording: To protect the privacy of all students, you are strictly prohibited from recording (audio or video) any live classes.

 

Violation of these conduct rules may result in immediate removal from the class and suspension of your account without refund.

6. Intellectual Property
All content provided on the Site, including but not limited to text, graphics, logos, videos, worksheets, and course materials, is the property of BIG Kids Academy and is protected by copyright laws.

 

• Usage License: You are granted a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial use only.

 

• Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, or sell any of our content without our prior written permission.

 

7. Technology Requirements
It is your responsibility to ensure you have the necessary equipment to access our Services, including:

 

• A reliable high-speed internet connection.

 

• A device with a working camera and microphone (for live classes).

 

• Access to Zoom Conferencing Platform.

 

BIG Kids Academy is not responsible for connectivity issues or technical failures on the user's end.

 

8. Limitation of Liability
To the fullest extent permitted by law, BIG Kids Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from:

 

• Your access to or use of or inability to access or use the Services.

 

• Any conduct or content of any third party on the Services.

 

• Unauthorized access, use, or alteration of your transmissions or content.

 

9. Governing Law
These Terms shall be governed and construed in accordance with the laws of New York, United States of America, without regard to its conflict of law provisions.

10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
